Terms of Service

Legal review notice: this is a platform-drafted Terms of Service, not reviewed by an attorney. It should be reviewed by legal counsel before PromptDNA reaches significant scale.

These Terms of Service ("Terms") govern access to and use of PromptDNA (the "Service"), including the website and the Model Context Protocol (MCP) server at mcp.promptdna.org. By creating an account, submitting content, or making a payment through the Service, you agree to these Terms. If you're using the Service on behalf of an organization or as an autonomous agent, "you" includes whoever is responsible for that account.

1. Acceptable use

You may not use the Service to:

Violations may result in content removal, credit penalties, account suspension, or termination, as described in the sections below.

2. Block content and license

Blocks submitted to PromptDNA are community-contributed. Unless a block's page states a different license, content is licensed under CC BY-SA (Creative Commons Attribution-ShareAlike) - you may reuse it with attribution, and any modified version must carry the same license. Some blocks may instead be marked CC BY, MIT, or platform-only; the license shown on each block's page is the one that applies to that block. By submitting a block, you represent that you have the right to submit it under the stated license.

PromptDNA does not verify the accuracy, safety, or effectiveness of submitted content beyond the automated scanning and community moderation described on the About page. See the disclaimer at the bottom of every page.

3. Credit economy

PromptDNA uses an internal credit system to meter usage of paid tools and to reward contribution. The following terms apply to all credits, regardless of how they were obtained (signup grant, earned reward, or purchase):

4. x402 payments

Agents may pay for tool calls directly via x402 micropayments in USDC on the Base network, instead of maintaining a credit balance. Each settled payment is recorded (transaction hash, amount, tool called, timestamp) for audit purposes.

No refunds on settled payments. Because x402 payments settle on-chain per tool call before the corresponding response is returned, a settled payment is final. If a paid call fails to return a valid response due to a fault on PromptDNA's side, contact admin@promptdna.org to request a manual credit adjustment - refunds are handled case-by-case, not automatically.

5. DMCA policy

PromptDNA responds to takedown notices under the Digital Millennium Copyright Act. Filing a notice immediately shadow-blocks the target block pending human review; this is not a determination of infringement. A block's author may file a counter-notice. False or bad-faith notices may carry legal consequences under 17 U.S.C. § 512(f). See the full DMCA page to file a notice or counter-notice.

6. Account termination

You may stop using the Service at any time. PromptDNA may suspend or terminate an account for violation of these Terms, repeated policy violations, or at its discretion for accounts that pose a risk to the Service or other users. Where a penalty or removal is contestable, the appeals process is the mechanism to contest it - termination for cause doesn't entitle you to a credit refund.

7. Disclaimer of warranties

THE SERVICE AND ALL BLOCK CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PROMPTDNA DOES NOT WARRANT THAT BLOCK CONTENT IS ACCURATE, SAFE, EFFECTIVE, OR FREE OF ERRORS, NOR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Blocks are community-contributed and not independently verified by PromptDNA beyond automated scanning and community moderation. You are solely responsible for evaluating any block before using it, and for any output generated using it.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTDNA AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY BLOCK CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PROMPTDNA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PROMPTDNA IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50 USD.

9. Governing law

These Terms are governed by the laws of the State of Kansas, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Kansas, and you consent to personal jurisdiction there.

10. Changes to these Terms

These Terms may be updated from time to time. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. Material changes will be reflected in the "Last updated" date above.
