(1) Estimate the probability of prevailing on liability, honestly and element by element — settlement analysis built on an inflated win probability produces bad decisions, so pressure-test the weakest element. (2) Estimate the damages range if the party prevails: the realistic low, likely, and high figures, since juries and courts vary and a point estimate hides the risk. (3) Compute the expected value: probability of winning times the likely recovery, then discount for collection risk (a judgment against an insolvent defendant is worth little) — this is the analytical anchor for any number. (4) Subtract the cost of continuing: attorney fees, expert costs, the party's time, and the years to resolution, all of which favor settlement even in a strong case. (5) Add the factors money doesn't capture but that matter: risk tolerance, the value of certainty and closure, confidentiality, precedent or reputational effects, and the relationship between the parties. (6) State a settlement range — the number below which trial is the better bet and above which settlement clearly wins — and note that case valuation is judgment-heavy and jurisdiction-dependent; a litigator familiar with the local forum should calibrate it.
