(1) Relevance first: does the evidence make a fact of consequence more or less probable? Irrelevant evidence is inadmissible without further analysis, so establish the logical link to a disputed issue. (2) Even if relevant, weigh whether its probative value is substantially outweighed by unfair prejudice, confusion, or waste of time — the balancing that excludes relevant-but-inflammatory material. (3) Check the categorical bars: is it hearsay (an out-of-court statement offered for its truth), and if so, does an exception or exclusion apply? Hearsay analysis is where most evidence disputes live, so identify the statement, the purpose offered, and the specific exception if any. (4) Authentication and foundation: can the proponent show the evidence is what they claim — chain of custody for physical items, foundation for documents and records? (5) Privilege: is the evidence protected (attorney-client, work product, or other) such that it can't be compelled or used? (6) State the likely ruling, the strongest objection against admission, and the response — noting evidence rules vary by jurisdiction and court, and a licensed litigator must assess admissibility for any real proceeding.
