Determine whether the precedent in {precedent_case} controls or can be distinguished from the situation in {current_facts}. (1) Extract the holding precisely: separate the actual rule the court applied to decide the case (the ratio) from broader language not necessary to the outcome (dicta), because only the holding binds and treating dicta as binding is a common error. (2) Identify the material facts the court relied on — the facts that, if changed, would have changed the result — as opposed to incidental facts. (3) Compare the current facts against those material facts point by point: genuine analogy requires similarity in the facts the rule actually turns on, not superficial resemblance. (4) Assess the precedent's authority over the current matter: is it binding (same jurisdiction, higher or coordinate court) or merely persuasive, and is it still good law or been overruled, limited, or distinguished by later cases? (5) Build both arguments honestly — why the precedent controls (the analogy) and why it's distinguishable (the material differences) — since the other side will press whichever you neglect. (6) State which argument is stronger and why, and note that precedent's force and current validity must be confirmed against up-to-date sources and, for any real matter, a licensed attorney.
